1. Educational and Informational Purpose Only
The exercises, workout routines, health information, and all other content provided in this App are for informational and educational purposes only. The content is not intended to be a substitute for professional medical advice, diagnosis, or treatment.
2. Not Medical Advice
The App and its content are NOT intended to:
- Diagnose, treat, cure, or prevent any disease or medical condition
- Replace the advice of a qualified healthcare professional
- Serve as medical or therapeutic treatment
- Provide personalized medical recommendations
3. Consult Your Physician
You agree not to perform any exercises or physical activities showcased in this App without first consulting a qualified medical professional to ensure such activities are safe for your individual health condition.
Before beginning any exercise program, including those presented in this App, you should:
- Consult with your physician or healthcare provider
- Obtain medical clearance for physical activity
- Discuss any health conditions, injuries, or concerns
- Follow all medical advice and restrictions
4. Assumption of Risk
You acknowledge that physical exercise involves inherent risks, including but not limited to physical injury, disability, and death. You voluntarily assume all risks associated with using this App and performing any exercises contained herein.
5. Release and Indemnification
To the fullest extent permitted by law, you agree to release, indemnify, and hold harmless the creators, owners, operators, developers, employees, agents, and affiliates of this App from any and all claims, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your use of the App
- Any injury, illness, disability, death, or damage to property resulting from your performance of any exercises or activities showcased in this App
- Your failure to consult with a medical professional before exercising
- Your violation of these Terms and Conditions
This indemnification shall survive the termination of your use of the App.
6. Subscription and Billing
By subscribing to the App, you authorize recurring charges to your payment method. Mobile subscriptions are managed through your device's app store settings. Web subscriptions are processed through Stripe via RevenueCat and can be managed through the billing portal linked from your purchase email or account management screen when available. Cancellation will prevent future charges but will not result in a refund for the current billing period.
Subscriptions may include a free trial for new users. If you do not cancel before the trial ends, your subscription will begin and you will be charged.
7. Refund Policy
All sales are final. Refund requests for mobile subscriptions are handled by the respective app store (Apple App Store or Google Play Store) according to their refund policies. Refund requests for web subscriptions are handled through the applicable Stripe and RevenueCat billing flows or as otherwise required by law. We do not guarantee refunds for partially used billing periods.
8. Binding Arbitration
Any dispute arising out of or related to use of this App shall be resolved by binding arbitration and not by a court or jury.
This arbitration provision is governed by the Federal Arbitration Act. The arbitration shall be conducted by a single arbitrator in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding.
By agreeing to these terms, you are waiving your right to a jury trial and your right to participate in a class action lawsuit.
9. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall the App creators, owners, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the App.
10. Modifications to Terms
We reserve the right to modify these Terms and Conditions at any time. Continued use of the App after any such changes constitutes your acceptance of the new Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
12. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.
